PMI PALMETTO VACATION RENTAL GUEST AGREEMENT

This Vacation Rental Agreement is entered into by and between {{guest}} and PMI PALMETTO for the vacation rental of {{listing}} as having an address of [{{listing_address}}.

The Terms and Conditions of this Agreement are as follows:
 

TERM. The rental term shall commence on the day of confirmed check-in until the day of confirmed check-out.

DAMAGE INSURANCE/SECURITY DEPOSIT. As part of our effort to help you relax and enjoy your stay, we insure the property against guest-caused, accidental damage with the Safely Protection Policy. The cost of this protection has been included in a Trust and Safety Fee or your rental rate. The Safely Protection Policy covers the cost of repairing damage to the property up to $3,000 for content and $3,000 for dwelling. Any deductible, minimum claim amount , or cost of repair in excess of the coverage limits will be the responsibility of the Guest, and PMI Palmetto will process the payment using the form of payment on file for the Guest. Additional information about the Safely Protection Policy will be provided upon request. Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to {{checkout}}.

USE. The Rental Property shall be used by the guest exclusively as a residence and shall not be used by more than the maximum occupancy limit.

ANIMALS. Animals are not permitted on the Rental Property without the prior consent of PMI Palmetto.

RULES DURING OCCUPANCY. Guests, and all persons residing at the Rental Property, agree to abide by the House Rules set by PMI Palmetto. In the event that the Rental Property is a portion of a building containing more than one unit or is located in a common interest development, guests agree to abide by all applicable rules, whether adopted before or after the date of this Rental Agreement, including rules with respect to noise, odors, disposal of refuse, animals, parking, and use of common areas. The guest will pay any penalties, including attorney fees, imposed by the homeowners’ association for violations by the Guest or Guest’s invitees.

Smoke-free: We maintain a clean and smoke-free environment for your comfort.

• Parties & Social Gatherings: Parties, gatherings, and other social functions are strictly prohibited.

• Noise: Guests and visitors should keep noise at a minimum between 9 pm to 8 am as a courtesy to the neighbors.

• Towels: Please do not use the white bath towels outside. After using, kindly separate the used beach/lake towels and white bath towels on your scheduled checkout.

• Safety Precaution: Guests using motorized water toys must adhere to Lake Murray's NO WAKE zones. Close to the docks is a NO WAKE ZONE. Please go into bigger water if you want to boat, tube, or jet ski. Children must wear life jackets while using stand-up paddle boards and be supervised by an adult when on the dock, swimming, using water toys (if applicable) as needed.

• Trash: Please segregate recyclable and compostable materials, and keep your trash in the trashcans located next to the road. Trash pick-up day is instructed on your check-out instructions.

• Other Things To Note:
  - Property treated for pests. Lakes provide habitat for a variety of creatures. Owner is not responsible for wildlife or insects.
  - Please flush only toilet paper. Do not flush wipes or any other items, even if labeled "flushable," as they can clog and damage the septic system.
  

ORDINANCES AND STATUTES. Guest, and all persons residing at the Rental Property, will abide by all statutes, ordinances, and requirements of all municipal, county, state, and federal authorities in effect during the Term set forth above, including, but not limited to, those relating to the use or sale of illicit drugs.

NO ASSIGNMENT OR SUBLETTING. Guests shall not assign or sublet the Rental Property without the prior written consent of PMI Palmetto.

MAINTENANCE AND DAMAGE. Guest acknowledges that, unless PMI Palmetto is notified within one hour of occupancy, the Rental Property, including all furnishings, appliances and other contents are in good working order and repair. Guest agrees to keep the Rental Property in a clean and sanitary condition and will immediately notify PMI Palmetto of any damage to the Rental Property or its contents, or any inoperable equipment or appliances. Guest/s will surrender the Rental Property, at check-out, in as good condition as it was received, normal wear and tear excepted. Guest agrees to be responsible for any damage caused by his or her family, invitees, or guests. Guest/s will not commit any waste upon the Rental Property or any nuisance or act which may disturb the quiet enjoyment of any other occupant in the complex. The guest understands and accepts that Property Damage Protection Insurance does not cover the Guest’s personal property.

ENTRY AND INSPECTION. PMI Palmetto company’s team members have the right to enter the Rental Property for the following reasons: (a) in case of emergency; (b) to make necessary or agreed repairs, decorations, alterations, improvements, or any other management services agreed to between Property Manager and Guest; (c) supply necessary or agreed services; and (d) after Guest has abandoned or surrendered the Rental Property. 

INDEMNIFICATION. PMI Palmetto will NOT be liable for any damage or injury to Guest, or any of Guest’s family, guests, or invitees, or any person, or any personal property, occurring on the Rental Property or in common areas unless such damage is the legal result of the negligence or willful misconduct of the Property Owner or Property Manager. Guest

agrees to hold Property Owner and Property Manager harmless from any claims for damages, no matter how caused, except for injury or damages caused by negligence or willful misconduct of Owner or Property Manager, respectively.

ATTORNEY’S FEES. In any action or proceeding involving a dispute between PMI Palmetto and Guest arising out of this Agreement, the prevailing party will be entitled to reasonable attorney’s fees and any additional costs and fees incurred before and during the dispute.

JURISDICTION AND CHOICE OF LAW. The parties agree that in the event of a dispute associated with this Agreement or the Rental Property that the Circuit or District Court of the rental property address shall have exclusive jurisdiction over the matter and the laws of the State shall govern any such dispute.

FAIR HOUSING. PMI Palmetto and Guest understand that the state and federal housing laws prohibit discrimination in the sale, rental, appraisal, financing, or advertising of housing on the basis of race, color, religion, sex, sexual orientation, marital status, national origin, ancestry, familial status, source of income, age, or mental or physical disability.

ADDITIONAL TERMS AND CONDITIONS. The House Rules for PMI Palmetto’s rental property sent in a separate message/email hereto are incorporated herein and made a part of this agreement by this reference. Property treated for pests. ENTIRE AGREEMENT - SEVERABILITY. The foregoing constitutes the entire agreement between the parties and may be modified only in writing and signed by the parties. This Agreement and any modifications, including any photocopy or fax, may be signed in one or more counterparts, each of which will be deemed an original and all of which taken together will constitute one and the same instrument. If there is more than one Guest, all guests are jointly and severally liable under this Agreement. If any provision of this Agreement is found to be prohibited by law or unenforceable, such invalidity shall not invalidate the remaining provisions of the Agreement.

PMI PALMETTO: DIRECT BOOKING CANCELLATIONS AND REFUNDS.

• Bookings canceled at least 30 days before the start of the stay will receive a 90% refund, excluding service fees and credit card processing fees.

• Bookings canceled at least 14 days before the start of the stay will receive a 40% refund, excluding services fees and credit card processing fees.

• No refund if you cancel less than 7 days before check-in.
  

TRAVEL INSURANCE. Travel Insurance is not required but may be added to your reservation.  

{{guest}} and PMI Palmetto have read and agreed to the above terms and conditions and acknowledge receipt of a copy of this Agreement by accepting the Terms and Conditions on this platform.
